The Senate met at 11 a.m.
(Senator Tomblin, Mr. President, in the Chair.)
Prayer was offered by the Honorable Shirley Love, a senator
from the eleventh district.
Pending the reading of the Journal of Monday, April 11, 2005,
On motion of Senator Minear, the Journal was approved and the
further reading thereof dispensed with.
At the request of Senator Chafin, and by unanimous consent,
the Senate suspended the joint rule with respect to a committee of
conference acting on matters not in disagreement between the two
houses on Engrossed Committee Substitute for House Bill No. 2005,
and further suspended all rules of the Senate in contravention of
the foregoing procedure in anticipated forthcoming action, as to
Engrossed Committee Substitute for House Bill No. 2005.
The Senate proceeded to the twelfth order of business.
Remarks were made by Senators Prezioso and Deem.
Senator Chafin then moved that the Senate adjourn until tomorrow, Wednesday, April 13, 2005, at 6 p.m.
The question being on the adoption of Senator Chafin's motion,
and on this question, Senator Chafin demanded the yeas and nays.
The roll being taken, the yeas were: Bailey, Barnes, Boley,
Bowman, Caruth, Chafin, Deem, Dempsey, Edgell, Facemyer, Fanning,
Foster, Harrison, Helmick, Jenkins, Love, McCabe, Minard, Minear,
Plymale, Prezioso, Sharpe, White and Tomblin (Mr. President)--24.
The nays were: Hunter, McKenzie, Oliverio, Sprouse, Unger,
Weeks and Yoder--7.
Absent: Guills, Kessler and Lanham--3.
So, a majority of those present and voting having voted in the
affirmative, the President declared Senator Chafin's motion had
prevailed.
In accordance with the foregoing motion, the Senate adjourned
until tomorrow, Wednesday, April 13, 2005, at 6 p.m.
